The StratationDesign website sells the following products: Digital files of 3D models meant for 3D printing.

The customer declares having read and accepted the general terms and conditions of sale prior to placing an order. Validation of the order therefore implies acceptance of the general terms and conditions of sale.

Article 1 - Object

The present conditions regulate the sales by the sole proprietorship named Stratation Design (45 rue Miss Sibley, 55100 VERDUN, France) of digital files of 3D models meant for 3D printing.

Article 2 - Price

The prices of our files are in US dollars. VAT is not applicable in France, according to article 293 B of the CGI.

The sole proprietorship named Stratation Design reserves the right to modify its prices at any time, but the file will be invoiced based on the price listed at the time of the validation of the order and subject to availability.

Article 3 - Intellectual property

The models and files remain the intellectual property of the sole proprietorship named Stratation Design.

All the elements of the www.stratationdesign.com website are and remain the intellectual and exclusive property of the sole proprietorship named Stratation Design. Any full or partial representation or reproduction made without the consent of the author or his successors in title is illegal and punishable under the laws relating to the offence of counterfeiting. The same applies to translation, adaptation or transformation, arrangement or reproduction by any art or process whatsoever. (Art. L. 122-4 of the CPI). Any simple link or hypertext link is strictly forbidden without the express written agreement of the sole proprietorship named Stratation Design.

In accordance with the CPI (Art. L. 121-1 to L. 121-9) will only be transferred to the client for the work described the economic rights explicitly stated in the conditions of right to the respect of the name. This right remains attached to its author in perpetuity and imprescriptible.

The original contractual information is presented in French and will be the subject of a confirmation upon validation of your order.

The sole proprietorship named Stratation Design reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

Article 5 - Validation of your order

Any order on the www.stratationdesign.com website implies acceptance of these General Terms and Conditions. Any order confirmation implies your full and complete adherence to these General Terms and Conditions of Sale, without exception or restrain.

All the data provided, and the recorded confirmation will serve as proof of the transaction.

You declare that you are fully aware of them.

The order confirmation will be considered as a signature and acceptance of the operations carried out.

Article 6 - Payment

The fact of validating your order implies for you the obligation to pay the price indicated.

The payment of your purchases is made thanks to the secured system of Squarespace.

Article 7 - Final Sale and No Cancellation

All sales of our digital products are final. Since digital products are delivered instantly and are intangible, we cannot offer returns, exchanges, refunds, or cancellations once the purchase is confirmed and the digital product is delivered. We encourage customers to carefully review the product descriptions and previews (if available) before making a purchase.

Article 8 - Defective Files or Misrepresentation

In the rare event that a digital product is defective or not as described, please contact us within 48 hours of purchase at contact[at]stratationdesign[dot]com. After reviewing the issue, we may, at our discretion, offer a replacement, make corrections to the file, or issue a store credit. In cases where the mistake is on our part, we may also opt to issue a refund. Our aim is to ensure customer satisfaction while maintaining the integrity of our digital products.

Article 9 - Retractation

The fact of validating your order implies that you waive your right of retraction.

Extract from article L121-21-8 of the French Consumer Code: "The right of retraction cannot be exercised for contracts for the supply of digital content not supplied on a physical medium, the execution of which has begun after the consumer's prior express agreement and express renunciation of his right of retraction."

Article 10 - Availability

Our files are available if they are visible on the www.stratationdesign.com website.

Article 11 - Warranty

Our files have been tested for printing using PLA (Polylactic Acid) filament on Creality CR10 Pro V2 and Bambu Lab X1-Carbon 3D printers for FDM (Fused Deposition Modeling) optimized models, as well as on Elegoo Mars and Creality LD-006 3D printers for SLA (Stereolithography) resin optimized models. However, we cannot guarantee the print quality that each individual will achieve on their own printer. Customers are responsible for ensuring the compatibility of their devices with our digital products.

Article 12 - Liability

The files presented conform to current French legislation. The responsibility of the sole proprietorship named Stratation Design cannot be engaged in case of non-respect of the legislation of the country where the file is downloaded. It is up to you to check with the local authorities the possibilities of importing or using the files you plan to download.

In addition, the sole proprietorship named Stratation Design cannot be held responsible for any damage resulting from improper use of the file purchased.

Finally, the sole proprietorship named Stratation Design cannot be held responsible for any inconvenience or damage inherent to the use of the Internet network, in particular a breakdown in service, external intrusion, or the presence of computer viruses.

Article 13 - Applicable law in the event of disputes

Article 14 - Personal data

The sole proprietorship named Stratation Design reserves the right to collect nominative information and personal data about you. They are necessary for the management of your order, as well as for the improvement of the services and information we send you.

They may also be transmitted to companies that contribute to these relations, such as those in charge of the execution of services and orders for their management, execution, processing and payment.

This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.

In accordance with the law of 6 January 1978, you have the right to access, rectify and oppose any nominative information and personal data concerning you, directly on the website.

Article 15 - Archiving Evidence

The sole proprietorship named Stratation Design will keep record of purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code.

The computerised registers of the sole proprietorship named Stratation Design will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
